TERMS and CONDITIONS

 

 1. Agreement & Acceptance of Terms

 

By reserving, booking, or participating in any travel services offered by INVEST EARTH LLC, doing business as MAGNO TOURS (“The Company”), you agree to be legally bound by these Terms & Conditions (“Terms”). Submission of any payment constitutes full acceptance of these Terms, forms a binding legal contract, and includes a waiver of the right to dispute these Terms. The person making the reservation represents and warrants that all participants have read, understood, and accepted these Terms and are authorized to act on their behalf. Participants must be at least 18 years of age.

 

2. Binding Nature of Contract

 

These Terms constitute a legally binding agreement. Failure to comply with any provision shall be considered a material breach of contract, resulting in cancellation of services and forfeiture of funds. No verbal statements, representations, or promises shall be binding unless confirmed in writing by an authorized representative of The Company.

 

3. Payments & Reservation Requirements

 

Reservations are confirmed only upon receipt of the required deposit. All payments must be made on or before the specified due dates. Failure to comply constitutes a material breach of contract and voluntary abandonment of the reservation, resulting in immediate cancellation and forfeiture of all funds paid without exception. Reinstatement is not guaranteed and may incur additional fees and supplier-related costs.

 

4. Forms of Payment

 

The Company accepts payments via Zelle, wire transfer, and direct bank deposit. All payments are final and non-reversible and constitute full acceptance of these Terms. Any associated bank fees are the responsibility of the participant.

 

5. Pricing & Adjustments

 

All prices are based on double occupancy unless otherwise stated and are subject to change due to supplier costs, fuel surcharges, currency fluctuations, and government-imposed taxes or fees.

 

In the event of pricing errors, The Company reserves the right to correct such errors. Participants may accept the corrected price or cancel the reservation without penalty.

 

6. Accuracy of Information

 

Participants are responsible for providing accurate personal and travel information. Failure to notify The Company of any errors within five (5) days of booking transfers full responsibility to the participant and may result in additional fees or cancellation without refund.

 

7. Travel Insurance

 

Travel insurance is strongly recommended. If declined, the participant accepts full financial responsibility for any loss and acknowledges that all cancellation penalties apply without exception, waiving any claim against The Company for financial loss.

 

8. Travel Documentation

 

Participants are solely responsible for obtaining valid travel documentation, including passports valid for at least six (6) months beyond the return date of the tour, visas, vaccinations, and any entry or exit requirements. The Company is not responsible for denied boarding, denied entry, or any associated costs resulting from incomplete or invalid documentation.

 

9. Participant Cancellations & Penalties

 

All cancellations must be submitted in writing via email to [email protected] and are only effective upon receipt and confirmation by The Company. The initial deposit is non-refundable. Cancellation penalties apply as follows: 45% if canceled 160–101 days prior to departure, 65% if canceled 100–76 days prior, and 100% if canceled 75 days or less prior to departure. These charges are agreed upon as liquidated damages representing a reasonable estimate of losses. Failure to make required payments, submit documentation, or respond to communications shall be deemed voluntary abandonment, triggering full cancellation penalties. No refunds will be issued for unused services after departure.

 

10. Refund Policy

 

Refunds, if applicable, are subject to supplier reimbursement and will only be processed after funds are received by The Company. The Company is not obligated to issue refunds if suppliers do not reimburse. Processing times are not guaranteed.

 

11. Chargebacks & Payment Disputes

 

Participants agree not to initiate chargebacks, reversals, or disputes with any financial institution. Any such action constitutes a fraudulent breach of contract, and the participant remains liable for all outstanding balances, legal fees, and collection costs.

 

12. Force Majeure

 

The Company shall not be liable for failure to perform due to events beyond its control, including but not limited to natural disasters, pandemics, government actions, or supplier disruptions.

 

In such cases, trips may be postponed. Credits if applicable, depend on supplier recovery of funds, and no refund is guaranteed.

 

13. Third-Party Suppliers

 

All services are provided by independent third-party suppliers. The Company does not control these providers and is not liable for their actions, errors, or omissions.

 

14. Limitation of Liability

 

To the fullest extent permitted by law, The Company shall not be liable for any personal injury, death, property damage, or financial loss.

 

15. Service Modifications

 

The Company reserves the right to modify itineraries, substitute services, or adjust accommodations when necessary. Comparable alternatives will be provided when possible.

 

16. Dispute Resolution, Claims & Jurisdiction

 

All disputes, claims, or demands arising out of or related to these Terms, any payment, reservation, cancellation, or travel services, whether before, during, or after travel, shall be governed exclusively by this section. Participants agree to submit any dispute to mandatory mediation in Cheyenne, Wyoming, prior to initiating legal action. Any claim must be submitted in writing within 30 days from the date of cancellation, scheduled departure, or completion of travel, whichever occurs first. Failure to comply constitutes a permanent waiver of the claim.

 

All legal actions must be brought exclusively in the courts of the State of Wyoming. Participants waive the right to a jury trial and to participate in class actions.

 

Initiating a dispute prior to departure does not eliminate contractual obligations or cancellation penalties. Personal reasons, financial hardship, or change of mind do not constitute valid grounds for a refund.

 

17. Collection Costs

 

Participants agree to pay all costs associated with the collection of unpaid balances, including attorney’s fees, court costs, and collection agency fees.

 

18. Severability

 

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
